When a Workplace Injury occurs, injured workers often are unsure of the steps that are involved in pursuing their benefits. After reporting their injury to their employer, the process is supposed to be streamlined so they can receive their benefits in a reasonable amount of time. Unfortunately, injured workers are often denied their benefits and sometimes left to pay their losses out of their own pocket. With this information, injured workers will know more about the process of filing for workers compensation.
There are three types of benefits a worker can receive if they were injured on the job or as a result of their job:
- A worker can receive wage benefits that pay them weekly for the work they are missing while they are recovering from their injuries. In the state of Georgia, the maximum amount of wage benefits an injured worker can receive each week is $550. The amount the worker will receive is averaged from the thirteen weeks of work they did prior to being injured.
- Medical benefits are paid directly by the employer and their insurance company. Injured workers are never billed for any medical services they need for care of their work-related injuries. The worker can also receive benefits for their mileage to the doctor and any prescription medications they need during the recovery process.
- Permanent and partial disability benefits are also given to workers. This can allow an injured worker to receive benefits indefinitely if they are disabled and cannot return to work or are partially disabled and can no longer work in the job they once held. This may also include vocational training benefits to help them worker find gainful employment.
Although the law prohibits an injured worker from suing their employer over a Workplace Injury, hiring a lawyer can still be beneficial because the lawyer can help with the appeals process if the employer and their insurance company deny the claim.
