Malpractice is a term used when someone in a professional practice is negligent in doing or failing to do something that causes injury, harm, or damage to a person. Medical malpractice, a form of malpractice many are familiar with, is present when there was something done or not done to the patient by a doctor or medical professional that causes them harm or injury. There are many causes and outcomes of medical malpractice, and unfortunately some of those are worse than others. Birth malpractice occurs when babies and mothers suffer injuries and harm before, during, and after the birthing process.

Injuries During Delivery

Giving birth is a very special time, and you want to trust that the doctors and the medical staff know what they are doing. As you are doing your part to bring a child into this world, it is reasonable to believe that everyone else is doing theirs. The birthing process is traumatic for the baby and the mother physically and emotionally. If the doctor is not taking extreme caution, the baby and mother can sustain grave injuries that could possibly lead to death. As the baby is coming through the birth canal it is important that the baby is receiving the appropriate amount of oxygen or brain damage can be caused. A doctor may choose to use the forceps or a vacuum to pull the baby out of the birth canal. These are acceptable tools to use, but if used incorrectly the baby can be delivered with brain damage or broken bones. If a doctor or member of their team harms you or your baby they should be held accountable, and that is what birth malpractice lawsuits are for.

C-Sections

Regardless of how people believe or what they feel, the fact is a cesarean section, also known as a c-section is surgery. In fact, it is major surgery. When a woman has a cesarean she receives a large cut in the abdomen area, then has the baby removed, and then she is stitched back together. The idea that a cesarean is not major surgery is absurd. Anytime surgery is done there is risk involved. If a doctor is negligent in scheduling the c-section on time, cuts the mother?s stomach incorrectly, or harms the baby in any way that is grounds for a birth malpractice lawsuit. It is an error on the part of the doctors, and the victim should be compensated.
